Types Of Lost Wages Compensation

Under Pennsylvania law the type of disability you have dictates the amount and term of your lost wages benefits. The 2 types of disability are Total Disability and Partial Disability.

Total Disability typically offers 2/3 of your gross weekly wages prior to the injury. Although there is a maximum weekly cap which, as of 2010, was $845.00/week.

Partial Disability allows those who return to light duty, lesser paying positions to receive  2/3 difference in pay for a maximum of 500 weeks.

Over time lost wages may be reduced if you ultimately receive another source of income such as SS Old Age, pension or unemployment benefits among others. Also, lost wages terms never allow for a cost of living increase under current Pennsylvania Workers’ Compensation law.
